Please read these terms carefully before using SELOS Rentals.

1. Introduction

SELOS Rentals is a digital marketplace that connects machinery and equipment owners ("Owners") with individuals, businesses, and organizations ("Clients") seeking machinery and equipment for construction, agriculture, transportation, mining support services, and related lawful activities.

By accessing, registering on, or using the SELOS Rentals platform, all users agree to be bound by these Terms and Conditions, as amended from time to time.

2. Role of SELOS Rentals

SELOS Rentals operates solely as an intermediary platform that facilitates connections between Owners and Clients.

SELOS Rentals:

  • Does not own, lease, operate, maintain, inspect, transport, supervise, or control any machinery or equipment listed on the platform.
  • Does not guarantee the quality, condition, performance, availability, safety, legality, or suitability of any machinery or equipment.
  • Is not a party to any rental agreement, service contract, transportation arrangement, or operational engagement entered into between Owners and Clients.
  • Is not responsible for the actions, omissions, conduct, or representations of any user of the platform.

All agreements and transactions relating to the rental, operation, transportation, or use of machinery are solely between the relevant Owner and Client. Client bookings are also subject to the Client Rental Agreement. Machinery listings are also subject to the Machinery Owner Agreement.

3. User Eligibility

To use the platform, users must:

  • Be at least eighteen (18) years of age.
  • Have the legal capacity and authority to enter into binding contracts.
  • Provide complete, accurate, and current information during registration and throughout their use of the platform.
  • Comply with all applicable laws, regulations, permits, and licensing requirements.
  • Use the platform only for lawful business purposes.

SELOS Rentals reserves the right to verify user information and reject or suspend accounts that fail to meet these requirements.

4. User Responsibilities

Users are responsible for:

  • Ensuring that all information provided on the platform is accurate and truthful.
  • Conducting their own due diligence before entering into any transaction.
  • Obtaining any permits, licenses, insurance, approvals, or authorizations required for the operation or use of machinery.
  • Ensuring that machinery is used safely, responsibly, and in compliance with all applicable laws and industry standards.
  • Promptly reporting any accidents, damages, misconduct, or safety incidents related to equipment rented through the platform.

5. Prohibited Activities

Users shall not use the platform or any machinery obtained through the platform for any unlawful, fraudulent, or prohibited purpose, including but not limited to:

  • Illegal mining activities.
  • Transportation of prohibited, hazardous, or unlawful goods without the required authorization.
  • Unlawful land encroachment or unauthorized occupation of land.
  • Fraudulent misrepresentation of projects, cargo, destinations, or intended use of equipment.
  • Submission of false, misleading, or inaccurate information.
  • Money laundering, bribery, corruption, or other criminal activities.
  • Any activity that may damage the reputation, security, or integrity of SELOS Rentals or its users.

SELOS Rentals reserves the right to report suspected illegal activities to relevant law enforcement or regulatory authorities.

6. Payments and Fees

All payments made through the platform shall be processed via approved payment service providers, including Paystack.

SELOS Rentals may charge commissions, transaction fees, service fees, subscription fees, platform fees, or other applicable charges.

Users agree to pay all applicable fees associated with their use of the platform.

SELOS Rentals reserves the right to modify its fee structure at any time, subject to appropriate notice where required.

Failure to make required payments may result in suspension or termination of access to the platform. Cancellations and refunds are governed by the Cancellation & Refund Policy.

7. Insurance and Risk

Owners and Clients are solely responsible for obtaining and maintaining any insurance coverage required for machinery rental, transportation, operation, or related activities.

SELOS Rentals does not provide insurance coverage for machinery, operators, projects, cargo, or users unless expressly stated otherwise.

All risks arising from the use, possession, transportation, or operation of machinery remain with the relevant Owner and Client.

8. Limitation of Liability

To the fullest extent permitted by law, SELOS Rentals shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or economic loss arising out of or related to:

  • Equipment breakdowns or mechanical failures.
  • Delays in project execution or completion.
  • Property damage.
  • Personal injury or loss of life.
  • Loss of revenue, profits, contracts, or business opportunities.
  • Theft, vandalism, or misuse of machinery.
  • Inaccurate listings, representations, or information provided by users.
  • Illegal or unauthorized activities conducted by users.
  • Disputes between Owners and Clients.

Users acknowledge that they utilize the platform at their own risk.

9. Indemnification

Users agree to indemnify, defend, and hold harmless SELOS Rentals, its directors, officers, employees, affiliates, agents, and partners from and against any claims, damages, losses, liabilities, costs, or expenses arising from:

  • Breach of these Terms and Conditions.
  • Violation of any law or regulation.
  • Misuse of machinery or equipment.
  • Disputes with other users.
  • Negligent, reckless, or unlawful conduct.

10. Account Suspension and Termination

SELOS Rentals reserves the right, at its sole discretion, to suspend, restrict, or terminate any account without prior notice where a user:

  • Engages in fraud, misconduct, or illegal activities.
  • Violates these Terms and Conditions.
  • Provides false or misleading information.
  • Compromises the security or integrity of the platform.
  • Engages in conduct harmful to other users or SELOS Rentals.

Termination of an account does not relieve a user of any outstanding obligations or liabilities.

11. Dispute Resolution

In the event of any dispute arising from the use of the platform, the parties shall first attempt to resolve the matter through good-faith negotiations and amicable discussions.

Where a dispute cannot be resolved amicably, it shall be referred to mediation or the competent courts of the Republic of Ghana, unless otherwise agreed by the parties.

12. Intellectual Property

All trademarks, logos, branding, software, content, and materials available on the SELOS Rentals platform are the property of SELOS Rentals or its licensors and may not be copied, reproduced, distributed, or used without prior written consent.

13. Privacy and Data Protection

Users consent to the collection, processing, storage, and use of personal information necessary for the operation of the platform, in accordance with applicable data protection laws and the SELOS Rentals Privacy Policy.

SELOS Rentals shall take reasonable measures to protect user information but does not guarantee absolute security.

14. Modifications to Terms

SELOS Rentals reserves the right to amend, update, or modify these Terms and Conditions at any time.

Continued use of the platform following any amendment constitutes acceptance of the revised Terms and Conditions.

15. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Ghana.

16. Acceptance

By registering for, accessing, or using the SELOS Rentals platform, users acknowledge that they have read, understood, and agreed to be bound by these Terms and Conditions.
