Machinery Owner Agreement

Terms that apply when you list machinery on SELOS Rentals.

This Machinery Owner Agreement ("Agreement") sets out the terms and conditions governing the listing and rental of machinery through the SELOS Rentals platform. It should be read together with our Terms & Conditions and Privacy Policy.

1. Owner Declaration

The Machinery Owner ("Owner") hereby declares and warrants that:

  • They are the lawful owner of the machinery listed on the SELOS Rentals platform or have full authority to act on behalf of the owner.
  • The machinery is in safe working condition and suitable for its intended use.
  • All information, documentation, certifications, and specifications provided to SELOS Rentals are accurate, complete, and current.
  • The machinery complies with all applicable laws, regulations, safety standards, and licensing requirements.

2. Owner Responsibilities

The Owner agrees to:

  • Maintain the machinery in a safe, reliable, and serviceable condition at all times.
  • Provide accurate and up-to-date specifications, performance data, and operating requirements for the machinery.
  • Ensure that all operators supplied by the Owner possess the necessary training, licenses, certifications, and qualifications required by law.
  • Promptly notify SELOS Rentals of any defects, safety concerns, operational limitations, or material changes affecting the machinery.
  • Conduct routine inspections, servicing, and maintenance in accordance with manufacturer recommendations and applicable industry standards.

3. Insurance

The Owner shall maintain all insurance coverage required by applicable law, including but not limited to equipment, liability, and operator insurance where applicable.

SELOS Rentals shall not be responsible for obtaining or maintaining insurance coverage on behalf of the Owner.

The Owner shall, upon request, provide evidence of valid insurance coverage.

4. Pricing and Rental Terms

The Owner retains the right to determine rental rates and pricing for listed machinery, subject to any pricing structures, commissions, or service fees agreed upon with SELOS Rentals.

SELOS Rentals reserves the right to display, market, and promote machinery listings on the platform in accordance with its policies.

5. Liability

The Owner acknowledges and agrees that they shall be solely responsible for:

  • Any equipment failure, malfunction, or breakdown.
  • Mechanical, electrical, or structural defects in the machinery.
  • Losses, damages, injuries, or claims arising from inadequate maintenance or inspection.
  • Negligence, misconduct, or non-compliance by operators supplied by the Owner.
  • Compliance with all applicable safety, environmental, and operational regulations.

SELOS Rentals shall not be liable for any direct, indirect, incidental, or consequential damages arising from the condition, operation, or maintenance of the Owner's machinery.

6. Indemnification

The Owner agrees to indemnify, defend, and hold harmless SELOS Rentals, its directors, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, and legal fees arising out of or related to:

  • Ownership, operation, maintenance, transportation, or rental of the machinery.
  • Breach of this Agreement by the Owner.
  • Personal injury, property damage, or third-party claims associated with the machinery.
  • Any violation of applicable laws, regulations, or industry standards by the Owner.

7. Termination

SELOS Rentals reserves the right, at its sole discretion, to suspend, remove, or terminate any machinery listing where:

  • Verification requirements are not satisfied.
  • False, misleading, or incomplete information has been provided.
  • The machinery poses a safety risk.
  • The Owner breaches this Agreement or any applicable SELOS Rentals policy.
  • Applicable laws or regulations require such removal or suspension.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Ghana. Any dispute arising from or relating to this Agreement shall be submitted to the courts of competent jurisdiction in Ghana.

9. Acceptance

By listing machinery on the SELOS Rentals platform, the Owner acknowledges that they have read, understood, and agreed to be bound by the terms of this Agreement.
